1. Acceptance of Terms
By accessing or using the Real Estate Compliance & Onboarding Portal (RCIP) (referred to as the "Platform" or "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
2. Account Registration & Security
Access to certain areas of the Platform requires registration. Users are classified under specific roles, including:
- Promoters: Individuals or organizations responsible for registering real estate projects and filing compliance forms.
- Professionals: Registered Architects, Structural Engineers, and Chartered Accountants responsible for validating project milestones and signing certificates.
- Group Administrators & Staff: Users authorized to manage onboarding and review submissions.
You are responsible for maintaining the confidentiality of your credentials, including session tokens and PKCE verification keys. Any activity originating from your account will be deemed your sole responsibility. You agree to notify us immediately of any unauthorized use of your credentials.
3. Compliance Filings & Submissions
The Platform allows Promoters and authorized professionals to submit compliance forms (e.g., Form 1, Form 2, Form 3, Form 4, project extension forms, and affidavits).
Submission Warranties:
By submitting any document or certificate, you represent and warrant that:
- All information provided is true, accurate, current, and complete.
- Calculations, project dimensions, financial receipts, and bank account figures match physical ledgers.
- Signatures from Chartered Accountants, Structural Engineers, and Architects are authentic and authorized.
- The submission complies fully with TG RERA (Telangana Real Estate Regulatory Authority) regulations.
4. Intellectual Property Rights
The Platform structure, UI designs, code, assets, and branding logos (excluding user-provided data and official state emblems) are the exclusive property of the Platform operator and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the Platform solely for statutory compliance purposes.
5. Prohibited Actions
While using the Platform, you agree not to:
- Submit falsified credentials, forged signatures, or deceptive project milestones.
- Use any automated tools (crawlers, scrapers, bots) to harvest compliance data.
- Attempt to bypass security measures, authentication filters, or session timeouts.
- Introduce malicious code, viruses, or Trojan horses designed to disrupt database integrity.
- Impersonate other promoters, staff, or registered professionals.
6. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from data inaccuracies. We do not assume responsibility for regulatory decisions made by RERA authorities based on information compiled through the Service.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Platform operators, affiliates, and developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of project registration status, financial fines levied by regulatory bodies, project delays, or business interruptions arising out of your use or inability to use the Platform.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, including the Real Estate (Regulation and Development) Act, 2016 (RERA) and rules established by the Telangana State Government. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana.
9. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When modifications are made, we will update the "Last Updated" date at the top of the page. Your continued use of the Platform after such changes constitutes acceptance of the new terms.
